Acceptance of Term

The web pages available at MyMalls.com and all linked pages ("Site") are brought to you by Global Malls Access Ltd., 21 Priory Office Park, Stillorgan, County Dublin, A94 F660, Ireland, and are accessed by you under the Terms of Use described below ("Terms").

Please read these Terms carefully before using the services. By accessing the site, viewing any content, or using any services available on the site (as each is defined below), you are agreeing to be bound by these Terms, which together with our Privacy Policy govern our relationship with you in relation to the site. If you disagree with any part of these Terms, you may not access the site.

Activation of a Member account or use of services provided by MyMalls.com will represent the Member's acceptance of this Agreement and the Member's authorisation for MyMalls (hereinafter “MyMalls.com”) to charge the Member's chosen payment method for all applicable charges.

MyMalls.com reserves the right, at its sole discretion, to change, modify, or otherwise alter these Terms of Service at any time. Any such revision will be binding and effective immediately upon posting of the revised agreement on our website. Your continued use of our site after that period constitutes agreement to any revision of the Terms of Service of this agreement.

MyMalls.com prohibits any illegal activity by its Members. Any charges incurred, legal or otherwise, by MyMalls.com in connection with the enforcement of the law against a Member or a potential Member will be the financial responsibility of that Member or potential Member. See the Indemnification section below for further details.

Governing Law

This Agreement shall be governed in all respects by the laws of Ireland. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the courts located in Ireland for any matter arising out of or relating to this Agreement.

Age Restriction

Our services are available only to individuals who are at least 18 years of age. By registering for a MyMalls account, you confirm that you are 18 years of age or older. We collect your date of birth at registration solely for the purpose of verifying this requirement.

If we discover or have reasonable grounds to believe that a Member is under 18 years of age, we reserve the right to immediately suspend or terminate that account and delete all associated personal data in accordance with our Privacy Policy. Any packages received on behalf of an underage account will be handled at MyMalls.com's discretion, and no refunds will be issued for charges already incurred.

Description of Services

MyMalls.com's services consist of receiving the Member's merchandise at our U.S. warehouse address, which will be sorted, packed, and shipped to the Member's specified recipient and address.

  • Your access to and use of the site may be interrupted from time to time as a result of equipment malfunction, updating, maintenance, repair of the site, or any other reason within or outside the control of MyMalls.com.
  • MyMalls.com reserves the right to suspend or discontinue the availability of the Site and/or any Service and/or remove any Content at any time at its sole discretion and without prior notice.
  • MyMalls.com may also impose limits on certain features and Services, or restrict your access to parts of or all of the Site and Services, without notice or liability.
  • The Site should not be used or relied upon for storage of photographs and images, and you are directed to retain your own copies of all content posted on the Site.

Registration and Authentication

As a condition of using our Services, you are required to open an account with MyMalls.com and provide accurate registration information, including your name, email address, phone number, date of birth, and destination country.

Authentication is handled exclusively via one-time passcode (OTP). We do not use or store passwords. When you log in or verify your identity, a unique OTP will be sent to your registered email. You are responsible for maintaining access to that email and for all activities conducted through your MyMalls.com account.

The registration information you provide must be accurate, complete, and current at all times. You are solely responsible for all activities resulting from the use of your account and any OTP codes issued to your registered email address.

If you believe your account has been compromised or your email address is no longer accessible, you must contact us immediately at support@mymalls.com.

Marketing Communications and Consent

During registration, you will be given the option to consent to receiving marketing communications from MyMalls.com, including promotions, service updates, and offers. This consent is voluntary and separate from the core service.

  • Providing consent: By creating a MyMalls account, you acknowledge that you have read, understood, and agree to the Terms of Service and our Privacy Policy.

  • Withdrawing consent: You may withdraw your marketing consent at any time by clicking the "unsubscribe" link in any marketing email, updating your preferences in your account settings, or contacting us at support@mymalls.com. Withdrawal will not affect the lawfulness of any processing carried out prior to withdrawal.

  • Record keeping: We record the date and time at which consent is given or withdrawn. This record is maintained for compliance purposes.

Withdrawing marketing consent does not affect your ability to use MyMalls.com's services, nor will it prevent us from sending you transactional or service-related communications necessary for your account.

Premium Membership

Membership starts the day the Member's application is received by MyMalls.com. MyMalls.com cannot send any shipments until all required documentation is received.

If a Member's account charges become delinquent for more than 150 days, MyMalls.com may, at its sole discretion, cancel the Member's account, process all packages by discarding them, and/or discard any mail. The Member forfeits all claims to items abandoned in their suite number once the membership is cancelled.

Annual memberships are automatically renewed unless the Member advises MyMalls.com in writing that they wish not to renew.

Either party may cancel the Membership Agreement with written notice by email to support@mymalls.com.

Data Retention and Account Closure

Upon cancellation or termination of your account, we will retain your personal data only for as long as required by law or as set out in our Privacy Policy. Specifically:

  • Account data will be retained for 2 years following account closure, after which it will be securely deleted or anonymised.
  • Transaction and financial records will be retained for 7 years to comply with statutory obligations.
  • Marketing consent records will be retained for 5 years after account closure for compliance purposes.
  • OTP codes are deleted immediately upon use or expiry and are never retained beyond that point.

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these Terms. It will hold harmless and indemnify MyMalls.com and its affiliates, officers, agents, and employees from any claim, suit, or action arising from or related to the use of the Services or violation of these Terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys' fees.

Referral Program

By sharing your MyMalls referral link, you agree to the following terms:

  • Every time someone uses your referral link to sign up for a MyMalls account, you will receive a $25 MyMalls credit when they make their first shipment.
  • Credits are only issued when someone registers using your unique referral link. Sign-ups directly at mymalls.com without using your referral link do not qualify. No exceptions.
  • You may not refer yourself or create additional accounts using your own referral link.
  • Credits will not be issued for referring existing or past MyMalls customers.
  • This programme cannot be combined with other offers.
  • We may suspend or cancel participation in the referral programme if we detect fraudulent or abusive behaviour.
  • We reserve the right to discontinue the referral programme at any time. Any outstanding credits earned prior to discontinuation will be honoured.

Package Handling

All packages received by MyMalls.com will be opened by company representatives. Members are responsible for all import obligations in the destination country.

You authorise MyMalls.com to:

Receive packages on your behalf
Charge the payment method on your account for all services and/or account activity, including but not limited to membership dues, shipping and handling, storage charges, late charges, and optional services. Failure to provide payment for services rendered may result in late charges, stop shipment charges, suspension of service, cancellation of membership, and the involuntary return or discarding of merchandise.

Shipping charges are based on weight, though dimensional charges may apply for bulky or lightweight packages.

MyMalls.com will allow active Members to store merchandise for up to 60 days at no charge. After this period, MyMalls.com may remove merchandise from the warehouse at its discretion.

Prohibited or restricted merchandise will not be stored and will be rejected, destroyed, or surrendered to government officials.

Preregistration Requirement: To streamline processing and prevent customs delays, all Members are required to preregister packages by uploading the purchase invoice immediately after making an online purchase. Preregistration should be completed in the Member's MyMalls suite or on the MyMalls app and should include the tracking number where available. Packages not preregistered will not receive manual item descriptions; only the tracking number will appear in the package description, which may affect processing time. By using MyMalls services, you acknowledge and agree to this preregistration requirement as a condition of service.

Discontinuation of Warehouse Pickup: The option to physically collect packages from the MyMalls warehouse in Miami is no longer available. This decision reflects legal considerations surrounding tax regulations and the MyMalls tax-free address. Discontinuation of this service is necessary to ensure compliance with applicable tax laws.

Each package received with an incomplete, incorrect, or old address that can be associated with a Member will be assessed a USD $5 charge. Members must ensure all merchants ship packages with the complete and accurate address, including the Member's unique suite number. Packages with unidentifiable addresses will be discarded if the Member cannot demonstrate ownership.

MyMalls.com reserves the right to return packages to the sender and/or discard items for any reason.

Mail Handling

When you set up an account with MyMalls.com, you agree to USPS Form 1583, which gives us permission to forward packages and mail to your delivery address as required by the U.S. Postal Service.

Items such as letters, cards, credit card bills, and magazine subscriptions are considered regular mail.

This form must be notarised by a licensed notary if you wish to ship regular mail with us. Notarisation may be completed in person or via Notarycam.

Prohibited / Restricted Items

The following items are among the most commonly restricted or prohibited items and may not be shipped through MyMalls.com:

  • Flammable, explosive, corrosive items (gasoline, paints, oil, etc.)
  • Pressurized cans, aerosol can or canisters (hairspray, paint spray can, etc.)
  • Any item prohibited by any applicable legislation or regulation restricting transport (ivory, seeds, etc.)
  • Hazardous, combustible or explosive material
  • Agriculture, produces and perishable foodstuffs (live or dead plants or animals, fur, fruits, etc.)
  • Items like perfume, cologne, nail Polish, alcohol base hand-sanitizer, flammable liquid
  • Cremated remain
  • Corrosive material
  • Negotiable securities and certificates, and monetary items (currency, coins, cash, precious stones, precious metal)
  • Stand-alone lithium-ion batteries (PI965) (power banks, certain jump starters, etc.)
  • Firearms, firearm parts and accessories (gun parts, scope, red dot sight, reflex sight, ammunition, and similar items
  • Any equipment that requires an ECCN (Export Control Classification Number)
  • AirSoft, bb-guns, and similar items.
  • Any restricted items under ITAR, Department of Commerce, US Customs and Border Protection, US Department of State and the US Department of Treasury.

Insurance

Insurance costs for shipments are based on declared value:

  • Up to USD $100 — Insurance is automatically included at no charge
  • USD $101–$1,000 — Insurance is optional, charged at 2.5% of declared value
  • Above USD $1,000 — Insurance is required, charged at 2.5% of declared value

The insured value is subject to the terms and conditions of the applicable carrier's airway bill. All claims are reviewed individually and any payment will be based on declared value.

Insurance does not cover/include:

  • Coins, bullion, loose diamonds or stones, stocks, bonds, currency, deeds, evidence of debt, travelers checks, money orders, gift certificates, calling cards, lottery tickets, or any other negotiable documents.
  • Loss from delay, deterioration, spoilage or contamination of perishable merchandise except when resulting from fire.
  • Merchandise shipped on consignment, memorandum or approval unless shipped in fulfillment of an order or request.
  • Loss, damage or non-arrival of any package or its contents which (a) is addressed, wrapped or packed insufficiently, incorrectly or contrary to carrier’s packaging requirements; or (b) bears a descriptive label or packaging which tends to describe nature of contents EXCEPT if shipped via Parcel Post and required by Postal Laws and Regulations.
  • Any package containing personal goods shipped on behalf of an employer or employee.
  • Any package shipped to a prohibited country. Prohibited countries include: Borneo.
  • Against loss or damage arising out of dishonesty on the part of the insured or insured’s employees.
  • Against loss or damage caused by or resulting from: (a) hostile or warlike action in time of peace or war, including action in hindering, combating or defending against an actual, impending or expected attack, (1) by any government or sovereign poser (de jure facto), or by any authority maintaining or using military, naval or air forces; or (2) by military, naval or air forces; (3) by an agent of any such government power, authority or forces (b) any weapon of war employing atomic fission or radioactive force whether in time of peace or war; (c) insurrection, rebellion, revolution, civil war, usurped power, or action taken by governmental authority in hindering, combating or defending against such an occurrence, seizure, or destruction under quarantine or Customs regulations, confiscation by order of any government or public authority or risks of contraband or illegal transportation of trade.
  • Against loss or damage caused by nuclear reaction/radiation or radioactive contamination, all whether controlled or uncontrolled, and whether such loss be direct or indirect, proximate or remote, or be in whole or in part caused by, contributed to, or aggravated by the peril(s) insured against in this Policy; however, direct loss by “fire” resulting from nuclear reaction/radiation or radioactive contamination is insured against by this Policy.

All conditions of MyMalls' third-party insurance provider and its relevant policies pass-through in applicability to MyMalls customers. For details of those conditions, please contact our support team.

Claims

MyMalls.com shall not be liable for the handling practices of carriers or customs authorities.

Claims for lost or damaged merchandise must be filed within the published time limits of the relevant carrier. A claim is considered filed when a fully completed claim form, photograph(s), and supporting documentation (including receipts) are received by MyMalls.com.

Any liability for delays, damage, or loss caused after delivery to MyMalls.com is limited to the lesser of the declared value, proof of purchase price, or the specific commodity liability limit.

MyMalls.com shall not be liable for damage or loss caused to items before delivery to our warehouse, or for merchandise prepackaged by a manufacturer.

MyMalls.com shall not be liable in cases of force majeure.

Claims are reviewed individually. The review process takes a minimum of 30 to 60 days. Specific categories — including televisions, computers, electronics, jewellery, figurines, furniture, and lighting — have limits of liability in cases of loss or damage, regardless of declared value or insurance costs paid.

Failure to file a completed claim within the carrier's time limit will invalidate the claim.

Limitation of Liability

You agree that MyMalls.com's entire liability, and your exclusive remedy, with respect to any services provided under this Agreement and any breach of this Agreement, is solely limited to the amount you paid for such service(s). MyMalls.com shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use any of its service(s), or for the cost of procurement of substitute services.

Packages are shipped from the MyMalls.com warehouse to the Member's address by MyMalls.com's shipping partners. MyMalls.com shall not be liable for the handling practices of its shipping couriers. For more information, please consult the Terms and Conditions of our shipping couriers.

Promotions

MyMalls.com shall not be liable for the handling of third-party promotions. For further information concerning promotions, please consult the relevant third party.

General

Trademarks

The trademarks, names, logos, and service marks displayed on the MyMalls.com website are registered and unregistered trademarks of the website owner or the respective store owner. Nothing on this website should be construed as granting any licence or right to use any trademark without prior written permission. Written content on this website may not be reproduced in whole or in part without the express written permission of the author. It is strictly forbidden to scrape any data from the MyMalls.com website. Scraping is considered trespass and/or theft.

Links

The Services may provide, or third parties may provide, links to other websites or resources. MyMalls.com has no control over such sites and resources, and is not responsible for their availability, content, advertising, products, or other materials. MyMalls.com shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by reliance on any content, goods, or services available through such sites or resources.

About these Terms

  • We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of our Services.
  • If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
  • These terms control the relationship between MyMalls.com and you. They do not create any third party beneficiary rights.
  • If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
  • If it turns out that a particular term is not enforceable, this will not affect any other terms.
